ESLaunch LLC, a California limited liability company doing business as ESLaunch (“ESLaunch,” “we,” “us,” or “our”), respects the privacy of individuals whose personal information we collect or process.

This Privacy Policy explains how ESLaunch collects, uses, retains, discloses, and otherwise processes personal information in connection with:

  • the ESLaunch website and other websites or pages that link to this Privacy Policy;
  • inquiries, consultations, booking pages, intake forms, quote or estimate tools, support requests, and communications with ESLaunch;
  • ESLaunch's website-development, local-search, Google Business Profile, content, social-media, lead-management, automation, artificial-intelligence, communications, reporting, maintenance, and related agency services;
  • ESLaunch's educational, informational, downloadable, licensed, or guided-implementation products;
  • client portals, accounts, dashboards, connected systems, and other service interfaces made available by or through ESLaunch; and
  • information ESLaunch processes while providing contracted services to business clients.

This Privacy Policy does not govern a third-party website, platform, software provider, telecommunications carrier, payment processor, social-media platform, search platform, artificial-intelligence provider, or other third party that maintains its own privacy policy.

1. ESLaunch's Privacy Roles

ESLaunch may process personal information in different roles depending on the circumstances.

1.1 Information ESLaunch Processes for Its Own Business Purposes

ESLaunch generally determines the purposes and means of processing information relating to:

  • prospective clients and customers;
  • purchasers or users of ESLaunch educational and digital products;
  • client representatives, personnel, and authorized users;
  • website visitors;
  • people who contact ESLaunch directly;
  • vendors, contractors, professional advisers, and business partners;
  • billing, account administration, fraud prevention, security, analytics, and business operations; and
  • ESLaunch marketing, portfolio, and customer-relationship activities.

For this information, ESLaunch may act as a business, controller, or equivalent responsible entity under applicable privacy law.

1.2 Information Processed for Business Clients

ESLaunch may receive or access personal information from or on behalf of a business client while operating or supporting client websites, forms, customer-relationship management systems, lead-routing systems, chatbots, phone systems, email or text-message workflows, appointment systems, reactivation campaigns, analytics, reporting, or other contracted services.

For personal information processed solely to perform contracted services for a client, the client generally determines why the information is collected and how it will be used. ESLaunch processes that information under the applicable agreement, Statement of Work, documented client instructions, and applicable law.

Depending on the contract and governing law, ESLaunch may qualify as a service provider, contractor, processor, or similar processing entity. Those classifications depend on the actual processing activity, applicable law, and required contractual restrictions; they do not apply automatically to every activity performed by ESLaunch.

Individuals seeking to exercise rights concerning information controlled by an ESLaunch client should ordinarily contact that client directly. Where contractually and legally applicable, ESLaunch will provide reasonable assistance to the client concerning verified requests involving information maintained in ESLaunch-controlled systems.

2. Personal Information We May Collect

“Personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to an individual or household. It does not include information excluded from the definition under applicable law, such as certain aggregated, deidentified, or publicly available information.

The information ESLaunch collects depends on how a person interacts with ESLaunch, which services are used, and which systems have been approved or enabled.

2.1 Contact and Identity Information

ESLaunch may collect:

  • name;
  • business name;
  • job title or role;
  • email address;
  • telephone number;
  • mailing or business address;
  • username or account identifier;
  • electronic signature;
  • social-media profile or business-profile information; and
  • information identifying an authorized client representative or account owner.

2.2 Business and Professional Information

ESLaunch may collect information concerning a client's or prospective client's:

  • business type, industry, services, and service areas;
  • business hours and contact information;
  • business licenses, insurance status, qualifications, and approved trust information;
  • website, domain, Google Business Profile, social profiles, and online listings;
  • branding, logos, photographs, videos, reviews, testimonials, and business content;
  • personnel, authorized users, vendors, and service providers;
  • competitors, target markets, customers, and marketing objectives;
  • offers, pricing, promotions, booking processes, estimates, and customer-service procedures;
  • lead-management, follow-up, sales, and communication processes;
  • technical systems, software subscriptions, integrations, and account configurations; and
  • other information submitted through onboarding forms, questionnaires, meetings, audits, or support interactions.

2.3 Inquiry, Intake, Booking, Form, and Calculator Information

When a person uses an inquiry form, booking page, request-a-quote form, calculator, chatbot, intake questionnaire, client portal, or similar tool, ESLaunch or a service provider may collect:

  • communications preferences;
  • lead source or referral information;
  • form-submission date and time;
  • consent, opt-in, opt-out, or suppression information; and
  • technical information associated with the submission.

A calculator, quote tool, or automated response may generate an estimate or suggested result based on the information entered. Unless expressly stated otherwise in a binding agreement, such output is informational and does not create a guarantee, binding quote, refund right, or promise of a particular result.

2.4 Account, Portal, and Credential Information

When needed to perform services, ESLaunch may receive:

  • account usernames;
  • administrative invitations;
  • access tokens;
  • API credentials;
  • authentication information;
  • account permissions;
  • domain or hosting access;
  • social-profile access;
  • Google Business Profile access;
  • communications-system access; and
  • other credentials or authorizations required for approved systems.

Clients should provide the minimum access reasonably necessary, use role-based access where available, enable multifactor authentication where appropriate, and promptly revoke access that is no longer required.

Clients should not send passwords or sensitive credentials through an insecure or unauthorized channel.

2.5 Transaction and Payment Information

ESLaunch may collect transaction-related information such as:

  • purchased service or product;
  • payment status;
  • billing contact information;
  • invoice information;
  • amount, date, and currency of a transaction;
  • subscription or recurring-service status;
  • payment method type;
  • processor transaction identifier;
  • refunds, credits, disputes, or chargeback information; and
  • records concerning authorization and acceptance of applicable terms.

Payment-card information is generally submitted directly to a third-party payment processor. ESLaunch should not receive or store complete payment-card numbers or card-security codes unless a specifically approved and compliant process is implemented.

The payment processor's collection and use of payment information are governed by its own terms and privacy practices.

2.6 Communications and Support Information

ESLaunch may collect information contained in or associated with:

  • emails;
  • text messages;
  • telephone calls;

  • other interactions with ESLaunch or systems operated for a client.

This may include message content, attachments, sender and recipient information, timestamps, call duration, routing information, support history, and communication preferences.

If calls, meetings, chatbot sessions, or other interactions are recorded, monitored, transcribed, or analyzed, ESLaunch or the applicable provider may process the recording, transcript, voice, and associated metadata. Such features should be used only after providing notices and obtaining permissions required by applicable law.

ESLaunch may record, monitor, transcribe, or analyze calls, meetings, voicemail, chatbot sessions, or similar interactions when the applicable feature is enabled. Before recording or transcription begins, ESLaunch or the applicable service provider will provide notice and obtain any consent required by applicable law. Recordings, transcripts, voice information, and associated metadata may be used for service delivery, quality assurance, support, security, documentation, training, and dispute resolution.

2.7 Client Customer and Lead Information

While providing contracted services, ESLaunch may process information about a client's prospective customers, leads, former customers, existing customers, or other contacts, including:

  • name;
  • email address;
  • telephone number;
  • service address or general location;

  • campaign participation;
  • consent, opt-in, opt-out, revocation, and suppression records;
  • delivery, routing, and response information; and
  • other information the client directs ESLaunch to process for an approved service.

The client is responsible for determining whether it has the authority, notice, consent, permission, or other lawful basis necessary to collect, provide, and use this information.

Clients may not provide unlawfully obtained, prohibited, fabricated, purchased, or scraped contact lists, or direct ESLaunch to send unlawful communications.

  • downloaded or accessed resources;
  • submitted assignments, questions, feedback, or implementation materials;
  • support and guidance communications;

2.10 Publicly Available Information

ESLaunch may collect information from public sources, including public websites, public business listings, Google Business Profiles, social-media profiles, customer reviews, public directories, public records, and other information lawfully made available to the general public.

Subject to the applicable client agreement and opt-out rights provided there, ESLaunch may use a client's name, logo, publicly available business information, public reviews, and publicly available completed work for portfolio, proposal, case-study, website, social-media, or similar business purposes.

2.11 Sensitive or Restricted Information

ESLaunch's ordinary services are not intended to require:

  • Social Security numbers;
  • complete payment-card information;
  • financial-account passwords;
  • protected medical information;
  • biometric templates or identifiers;
  • government identification numbers;
  • precise geolocation;
  • information concerning children;
  • highly sensitive employment information; or
  • similarly regulated or high-risk information.

Clients and users must not provide such information unless ESLaunch has expressly approved the processing in a separate written agreement or addendum.

ESLaunch may process limited information that some laws classify as sensitive, such as account credentials or the contents of certain communications, when reasonably necessary to provide requested services, protect accounts, complete transactions, or comply with law.

  • automatically through cookies, pixels, log files, software development kits, and similar technologies; and
  • through inferences generated from the information described in this Privacy Policy.

4. How ESLaunch Uses Personal Information

ESLaunch may use personal information to:

  • respond to inquiries and communicate with prospective clients;
  • schedule consultations, demonstrations, meetings, or appointments;
  • evaluate service needs and prepare proposals or recommendations;

ESLaunch does not use Client Data processed solely for contracted services for independent advertising, unrelated profiling, or unrelated product development except where separately authorized and legally permitted.

5. Artificial Intelligence and Automated Systems

ESLaunch's services may use artificial-intelligence or automated systems to support functions such as:

  • website chat;
  • telephone reception;
  • answering approved common questions;
  • collecting lead information;
  • routing calls or inquiries;

Information submitted to an artificial-intelligence feature may be transmitted to and processed by the providers supporting that feature. Depending on the system, this may include prompts, conversation content, recordings, transcripts, uploaded information, generated output, technical metadata, and feedback.

Artificial-intelligence providers may process information according to their own terms, privacy policies, contractual arrangements, and technical settings. ESLaunch does not represent that every provider offers the same retention, security, training, confidentiality, or deletion controls.

Users and clients must not submit restricted, highly sensitive, regulated, or confidential information to an artificial-intelligence system unless the system and processing have been specifically approved for that information.

Artificial-intelligence output may be incomplete, inaccurate, biased, outdated, or unsuitable. Material output should receive appropriate human review before it is published, relied upon, or used to make a consequential decision.

Unless expressly disclosed and legally supported, ESLaunch does not use automated systems to make final decisions that produce legal or similarly significant effects concerning an individual.

ESLaunch may disclose lead, customer, inquiry, appointment, form, chatbot, telephone, text-message, or email information to the client and the persons, accounts, software systems, or destinations the client has approved.

6.3 Payment Processors and Transaction Providers

ESLaunch may provide transaction and billing information to payment processors, banks, fraud-prevention providers, checkout platforms, and related providers to complete transactions, process recurring payments, investigate disputes, and prevent fraud.

7. Cookies and Similar Technologies

  • website operation and security;
  • session management;
  • saved preferences;
  • fraud prevention;
  • form and account functionality;
  • analytics and performance measurement;
  • referral and campaign attribution;
  • communication and conversion measurement; and
  • advertising or retargeting, but only if such technologies are actually enabled.

Users may be able to manage cookies through browser settings or a cookie-preference tool made available on the website. Blocking certain technologies may cause parts of a website or service to function incorrectly.

Browser “Do Not Track” signals are not interpreted uniformly across the industry. Where required by applicable law, ESLaunch will process legally recognized opt-out preference signals, such as Global Privacy Control, for the browser or device transmitting the signal.

ESLaunch uses cookies and similar technologies for website operation, security, forms, account functionality, analytics, performance measurement, and referral attribution. Users may manage cookies through browser settings and any cookie-preference tool made available on the website.

8. Sale, Sharing, and Targeted Advertising

ESLaunch does not sell personal information for monetary consideration. ESLaunch does not sell or share Client Data processed solely to perform contracted services or use such Client Data for independent cross-context behavioral advertising or unrelated profiling. ESLaunch does not currently share personal information for cross-context behavioral advertising or use advertising-retargeting or audience-matching technologies. If these practices change, ESLaunch will update this Privacy Policy and implement any legally required notices, preference controls, consent mechanisms, and opt-out rights before enabling the changed practice. ESLaunch will not discriminate against an individual for exercising an applicable right to opt out.

9. Email, Text-Message, and Telephone Communications

ESLaunch may send:

  • responses to inquiries;
  • appointment confirmations and reminders;
  • service, transaction, account, security, or support messages;
  • requested information;
  • approved follow-up communications;
  • educational or product communications; and
  • marketing or promotional communications where permitted.

Recipients may opt out of promotional emails by using the unsubscribe mechanism in the email or contacting ESLaunch.

Recipients may opt out of promotional text messages by following the instructions in the message, including replying with an applicable opt-out keyword where that option is supported.

Opting out of marketing does not prevent ESLaunch from sending nonpromotional communications reasonably necessary for a transaction, requested service, account, security matter, legal notice, or active business relationship.

Where ESLaunch sends communications on behalf of a client, the client is responsible for determining recipient eligibility, obtaining required consent, maintaining consent and suppression records, approving message content and timing, and processing opt-out or revocation requests. ESLaunch may implement reasonable rate limits, suppression controls, sender identification, disclosures, and other risk-reduction measures.

10. Client Data Responsibilities

A client that provides or makes personal information available to ESLaunch represents that it has:

  • the legal authority to collect and provide the information;
  • delivered any required privacy notices;
  • obtained any required consent or permission;
  • limited the information to what is reasonably necessary;
  • maintained appropriate opt-in, opt-out, revocation, and suppression records;
  • complied with applicable restrictions concerning email, text messages, telephone calls, recordings, automated communications, and artificial-intelligence-generated or prerecorded voice; and
  • provided accurate instructions concerning use, retention, disclosure, and deletion.

ESLaunch may refuse, suspend, or stop processing that it reasonably believes is unlawful, unauthorized, deceptive, insecure, prohibited by a provider, or likely to create material legal, security, carrier, platform, or reputational risk.

11. Data Retention

ESLaunch retains personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:

  • provide requested services or products;
  • maintain an active client or customer relationship;
  • complete transactions and recurring billing;
  • maintain business, tax, accounting, contractual, consent, suppression, and transaction records;
  • protect systems and prevent fraud or abuse;
  • resolve disputes, chargebacks, and payment issues;
  • enforce agreements and establish or defend legal claims;
  • comply with legal and regulatory requirements; and
  • maintain routine backups and business-continuity systems.

Retention periods vary based on:

  • the nature and sensitivity of the information;
  • the purpose for which it was collected;
  • the length of the client or customer relationship;
  • contractual requirements;
  • legal limitation periods;
  • tax, accounting, and recordkeeping requirements;
  • security and fraud-prevention needs;
  • available deletion and export functionality;
  • the configuration and retention practices of third-party providers; and
  • whether the information is maintained in active systems, archives, logs, or backups.

For Client Data processed under a services agreement, return, export, deletion, access removal, and handoff are governed by the applicable agreement and Statement of Work. Such actions may be subject to legal obligations, dispute or payment issues, routine backups, technical feasibility, available export formats, provider limitations, and the completion of any agreed or billable transition services.

Backup copies may remain until overwritten or deleted in the ordinary course, but remain subject to applicable confidentiality and security protections while retained.

ESLaunch does not promise that all information will be deleted immediately when a service, subscription, account, or client relationship ends.

12. Data Security

ESLaunch uses reasonable administrative, technical, and organizational safeguards appropriate to the nature of the information and the systems within ESLaunch's control.

Depending on the system and circumstances, safeguards may include:

  • access controls;
  • authentication measures;
  • credential-management practices;
  • role-based access;
  • multifactor authentication where available;
  • vendor and account configuration;
  • logging and monitoring;
  • backups;
  • software updates;
  • rate limits;
  • input validation;
  • spam or abuse controls;
  • contractor confidentiality obligations;
  • incident-response procedures; and
  • other commercially reasonable security measures.

No website, software, artificial-intelligence system, communications system, storage method, or transmission method is completely secure, uninterrupted, or immune from unauthorized access, error, malware, platform failure, or other security incidents.

ESLaunch does not guarantee that a breach, unauthorized access, system interruption, data loss, or other security event will never occur.

Clients remain responsible for their own devices, users, passwords, access permissions, accounts, networks, employee practices, and Client-controlled systems.

13. Interstate and International Processing

ESLaunch is based in the United States. ESLaunch and its providers may process information in California, elsewhere in the United States, or in another jurisdiction where ESLaunch or a provider operates.

Privacy, data-protection, law-enforcement-access, and governmental-access rules may differ between jurisdictions.

Where legally required, ESLaunch will use an appropriate mechanism for a regulated international transfer. ESLaunch does not represent that every service or provider is available or legally suitable in every jurisdiction.

14. Privacy Rights

Depending on the individual's location, applicable law, and ESLaunch's role, an individual may have the right to:

  • confirm whether personal information is being processed;
  • request access to or a copy of personal information;
  • request correction of inaccurate personal information;
  • request deletion of personal information;
  • request information about categories, sources, purposes, or recipients;
  • request portability of certain information;
  • opt out of the sale or sharing of personal information;

  • withdraw consent where processing is based on consent;
  • object to or restrict certain processing;
  • appeal a denied request where applicable; and
  • receive equal service and pricing without unlawful discrimination for exercising applicable privacy rights.

These rights are not absolute. ESLaunch may deny or limit a request where permitted by law, including when ESLaunch cannot verify the request, must retain information, processes the information solely for a client, or an exception applies.

15. California Privacy Disclosures

This section applies to California residents to the extent the California Consumer Privacy Act, as amended, applies to ESLaunch or the relevant processing activity.

ESLaunch does not use Client Data processed solely for contracted services to infer characteristics about individuals or for independent advertising or profiling.

15.4 Sale and Sharing

The disclosure required for ESLaunch-controlled website and marketing data must match the final determination made under Section 8 after completion of a cookie, tag, analytics, and advertising-technology audit.

ESLaunch retains personal information only for as long as reasonably necessary to provide the applicable services, administer accounts and transactions, maintain business and tax records, enforce agreements, resolve disputes, protect security, comply with legal obligations, and complete ordinary backup cycles. Client Data processed on behalf of a business client is retained and deleted according to the applicable MSA, SOW, Data Processing Addendum, documented Client instructions, legal requirements, and applicable provider limitations. When information is no longer reasonably necessary, ESLaunch may delete, deidentify, or aggregate it, subject to lawful backup, security, litigation-hold, billing, and recordkeeping requirements.

18. Authorized Agents

Where applicable law permits an authorized agent to submit a request, ESLaunch may require:

  • written permission signed by the individual;
  • proof that the agent is registered or otherwise authorized where required;
  • verification of the individual's identity; and
  • direct confirmation that the individual authorized the request.

A valid power of attorney may be handled according to applicable law.

19. Requests Concerning Client-Controlled Information

When ESLaunch holds information solely on behalf of a business client, the client ordinarily controls the response to a privacy request.

ESLaunch may:

  • direct the requester to the client;
  • notify the client of the request;
  • provide reasonable assistance to the client; and
  • take action concerning information in ESLaunch-controlled systems when instructed by the client and permitted by the governing agreement and law.

ESLaunch will not independently grant access to or delete client-controlled records when doing so would conflict with the client's lawful instructions, the governing agreement, another person's rights, or applicable law.

20. Appeals

If applicable law provides a right to appeal a denied privacy request, the individual may submit an appeal to support@eslaunch.com with the subject line “Privacy Request Appeal.”

The appeal should identify the original request, the decision being appealed, and any relevant supporting information.

ESLaunch will evaluate the appeal and respond within the period required by applicable law.

21. Non-Discrimination

ESLaunch will not unlawfully discriminate against an individual for exercising an applicable privacy right.

This does not prevent ESLaunch from:

  • charging a different price or providing a different service when the difference is reasonably related to the value or cost of the relevant data and is permitted by law;
  • declining to provide a service that cannot reasonably be performed without the requested information; or
  • enforcing legitimate contractual, security, payment, fraud-prevention, or eligibility requirements.

22. Children's Privacy

ESLaunch's websites, services, accounts, and products are intended for individuals who are at least eighteen (18) years old. ESLaunch does not knowingly collect personal information online directly from children under thirteen (13).

Clients may not provide children's information to ESLaunch or configure ESLaunch-supported systems to target or collect information from children without a separate written agreement, appropriate legal review, and all required notices and permissions.

If ESLaunch learns that it collected personal information from a child in circumstances requiring parental consent without obtaining that consent, ESLaunch will take reasonable steps to delete or otherwise address the information as required by applicable law.

23. Third-Party Websites, Platforms, and Integrations

ESLaunch websites, products, communications, or client systems may contain links to or integrate with third-party services.

ESLaunch does not control third parties':

  • privacy practices;
  • security;
  • availability;
  • pricing;
  • approval or verification decisions;
  • retention practices;
  • artificial-intelligence training practices;
  • account restrictions;
  • software changes;
  • outages; or
  • compliance with their own terms.

Individuals and clients should review each third party's terms, privacy policy, fees, settings, and suitability before using the service or providing information.

A link, recommendation, configuration, or integration does not mean ESLaunch owns, controls, endorses, or guarantees the third-party service.

24. Purchases, Subscriptions, Refunds, and Service Guarantees

This Privacy Policy governs privacy practices. It does not create a refund, cancellation, credit, service-level, satisfaction, performance, security, uptime, ranking, lead, booking, sales, revenue, profit, or return-on-investment guarantee.

Purchases, subscriptions, recurring services, cancellations, refunds, credits, payment disputes, and any applicable Conditional Service Quality Guarantee are governed exclusively by the applicable:

  • Terms and Conditions;
  • Refund Policy;
  • Master Services Agreement;
  • Statement of Work;
  • Order Form;
  • checkout terms; and
  • other written agreement accepted by the parties.

Nothing in this Privacy Policy expands or modifies a commercial remedy provided by those documents.

A privacy request does not cancel a subscription, terminate a minimum commitment, resolve a billing dispute, waive an unpaid amount, or create a refund right. Cancellation, termination, and billing requests must be submitted through the method required by the applicable commercial agreement.

25. Changes to This Privacy Policy

ESLaunch may update this Privacy Policy to reflect changes in services, technology, providers, data practices, or legal requirements.

The revised policy will be posted with an updated “Last Updated” date. ESLaunch may provide additional notice where required by law or where a change materially affects previously disclosed practices.

Unless applicable law requires otherwise, a revised policy applies prospectively from its stated effective date.
